ThreatMon is a SaaS platform providing advanced Cyber Threat Intelligence, Attack Surface Monitoring, Fraud Intelligence, Dark Web Intelligence, and Surface Web Intelligence services. Our intelligence insights are derived from publicly available data collected through passive scanning techniques and are displayed to customers who have purchased our services (“Customers”) and authorized users (collectively, “Users”) via our proprietary technology. We do not collect, store, process, or otherwise use personal data, other than login credentials.

If you are a Customer or an individual authorized by a Customer to use the Platform, your use of the Platform is governed by the Software as a Service License & Customer Agreement.

The Website Terms and Conditions found here (“Website Terms” or “Website”) govern your use of ThreatMon’s website as a visitor (“Visitor”).

Overview and Acceptance of Terms

By accessing and using the ThreatMon platform (“Platform”), including trial, free trial, and proof of concept (POC) services, you agree to comply with these Terms of Use (“Terms”) as well as any other relevant policies and notices on our website. ThreatMon reserves the right to update or amend these Terms at any time, and it is your responsibility to periodically review these Terms for any updates.

These Platform Terms apply in full force to your use of the Platform, and by using the Platform, you expressly agree to and accept all the terms and conditions contained herein. If you object to or do not accept any of these Platform Terms, you should not use this Platform.

Services and Data Usage

• ThreatMon provides threat intelligence, security monitoring, and digital risk detection solutions.ThreatMon does not collect, store, or use personal data beyond login credentials.
• Users of the Platform must ensure that any data or information they submit does not contain sensitive or personally identifiable information unless explicitly agreed.

Account Responsibilities

• You are responsible for maintaining the security of your login credentials and agree not to share them with others. Any unauthorized access or breach of your account should be reported to ThreatMon immediately.
• ThreatMon reserves the right to suspend or terminate access to the Platform if misuse, unauthorized access, or security violations are detected.

Access and Usage Rights

Right to Use. Subject to the Platform Terms of Use, ThreatMon grants Users a non-exclusive right to access the Platform solely to:

• Evaluate the Platform as part of a Trial or Proof of Concept;
• Utilize those portions of the Platform made available at no charge,vincluding but not limited to accessing threat intelligence insights, monitoring digital assets, and managing non-sensitive security information.

Limited Rights. A User’s rights in the Platform are strictly limited to those access rights expressly granted in these Platform Terms. ThreatMon reserves all rights and licenses in and to the Platform that are not explicitly granted to Users under these Platform Terms.

Trial/Proof of Concept. Any information entered on the Platform as part of a Trial or Proof of Concept can be deleted upon request. To initiate deletion, please contact your ThreatMon Account Executive or reach out to our support team at [email protected]. Note that this does not apply to information provided to a third party in response to questionnaires or remediation requests.

Restrictions. Except as necessary for authorized use of the Platform, Users shall not:

• (a) Attempt to interfere with, disrupt, or gain unauthorized access to the Platform or any connected systems or networks;
• (b) Share login credentials or allow any unauthorized person access to the Platform;
• (c) Copy, modify, or create derivative works from any part of the Platform;
• (d) Distribute, transfer, sublicense, lease, lend, or rent any part of the Platform to third parties;
• (e) Alter or remove proprietary notices on the Platform;
• (f) Use the Platform for unlawful purposes or in any way that negatively impacts its availability or violates Platform documentation; or
• (g) Disclose, publish, or share results of tests, benchmarks, or assessments of the Platform without ThreatMon’s prior written permission.

Users acknowledge that certain aspects of the Platform contain trade secrets of ThreatMon and its licensors. Users therefore agree not to disassemble, decompile, or reverse-engineer the Platform or allow any third party to do so, unless explicitly permitted by applicable law.

Prohibited Conduct. In addition to the restrictions listed above, Users are prohibited from using the Platform and its contents:

• For deceptive, fraudulent, or unauthorized competitive intelligence purposes;
• For illegal or unethical activities, or to solicit others to engage in such activities;
• To harass, defame, intimidate, insult, or discriminate against others based on characteristics such as gender, sexual orientation, ethnicity, religion, race, nationality, or disability;
• To collect or track the personal information of others without consent;
• To infringe upon the intellectual property or proprietary rights of others;
• To bypass or interfere with the security measures of the Platform or any associated website; and
• To violate any applicable international, federal, state, or local laws and regulations.

ThreatMon reserves the right to suspend or terminate a User’s access to the Platform immediately, without prior notice, if prohibited conduct or violations of these Terms are suspected.

THE SERVICE AND THE THREAT INTELLIGENCE DATA ARE PROVIDED “AS IS,” AND THREATMONIT MAKES NO (AND HEREBY DISCLAIMS ALL) WARRANTIES, REPRESENTATIONS, OR CONDITIONS, WHETHER WRITTEN, ORAL, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, TITLE, NONINFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE USE, MISUSE, OR INABILITY TO USE THE SERVICE (IN WHOLE OR IN PART), THE THREAT INTELLIGENCE DATA, OR ANY OTHER PRODUCTS OR SERVICES PROVIDED TO YOU BY THREATMONIT. THREATMONIT DOES NOT WARRANT THAT SEARCHES PERFORMED BY THE SERVICE WILL REVEAL ANY OR ALL SECURITY THREATS OR PREDICT ANY OR ALL ATTACKS, THAT THE THREAT INTELLIGENCE DATA WILL BE ACCURATE OR COMPLETE, OR THAT OPERATION OF THE SERVICE SHALL BE UNINTERRUPTED OR ERROR-FREE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THREATMONIT DISCLAIMS ANY LIABILITY FOR, AND SHALL NOT BE RESPONSIBLE IN ANY WAY REGARDING, ANY THIRD-PARTY CONTENT, INFORMATION, MATERIALS, LINKS, FILES, OR SEARCH RESULTS THAT MAY BE ACCESSIBLE THROUGH THE SERVICE OR THE THREAT INTELLIGENCE DATA.

LIMITATION OF LIABILITY

IN NO EVENT SHALL THREATMONIT BE LIABLE TO YOU FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES OR COSTS DUE TO ANY DIRECT OR INDIRECT LOSS OF PROFITS, DATA, USE OR GOODWILL, PERSONAL OR PROPERTY DAMAGE RESULTING FROM OR IN CONNECTION WITH THIS PLATFORM OF USE, THE SERVICE, OR THE USE OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, EVEN IF THREATMONIT HAS BEEN NOTIFIED OF THE LIKELIHOOD OF SUCH DAMAGES.

THE MAXIMUM AGGREGATE LIABILITY OF THREATMONIT ARISING OUT OF OR IN ANY WAY CONNECTED TO THIS PLATFORM OF USE WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE BUT EXCLUDING WILLFUL MISCONDUCT) OR OTHERWISE, SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US$100). THE EXISTENCE OF ONE OR MORE CLAIMS UNDER THIS PLATFORM OF USE WILL NOT INCREASE THREATMONIT’S LIABILITY.

Modification of Services

ThreatMon may modify or discontinue parts or all of the Platform without notice and is not liable for any resulting changes, including suspensions due to misuse, fraudulent activities, or breach of these Terms.

Data Security and Compliance

ThreatMon employs strict security practices to protect Platform data, and users agree to adhere to all applicable laws, including data privacy regulations. All information, including usage data, is managed according to ThreatMon’s Privacy Policy.

Indemnification

You hereby indemnify to the fullest extent ThreatMon from and against any and all liabilities, costs, demands, causes of action, damages and expenses arising out of or in any way related to your breach of any of the provisions of these Platform Terms.

Intellectual Property

The Platform, including its technology, data, and methodologies, is the exclusive property of ThreatMon and its licensors. Users may not duplicate, distribute, or otherwise exploit Platform content without authorization.

Feedback and Suggestions

By providing feedback, you grant ThreatMon a non-exclusive, royalty-free license to use such suggestions to improve the Platform.

Severability

If any provision of these Terms is deemed invalid or unenforceable, it will not affect the validity of the remaining provisions, which will remain in effect to the fullest extent permitted by law.

Governing Law and Jurisdiction

These Terms are governed by the laws of [applicable jurisdiction]. Users consent to the exclusive jurisdiction of the courts in [specified location] for any disputes arising from these Terms.

Changes to Terms
